1. Who may use the site
The site is meant for businesses and adults. You must be at least the age of majority where you live, or use the site with the involvement of a parent or guardian. If you use the site for an organisation, you confirm that you may accept these terms for it, and "you" includes that organisation.
2. Information, not an offer
Everything on the site, including descriptions of our services and products, case studies, figures, pricing models, timelines and launch dates, is general information. It may be incomplete or change without notice, and it is not professional, legal, financial or technical advice.
Nothing on the site is an offer, quote, guarantee or binding commitment. We are bound only by a written agreement signed by TRGS. Scope, price, timing and deliverables are set in that agreement, and where it differs from anything on the site, the agreement governs.
3. The TRGS agent and other tools
The site offers interactive tools: the TRGS agent (an AI assistant that takes your brief), the "Something else" box, links that pass an idea to the agent, and contact forms.
- It is automated. The agent's replies are produced by an AI model. They can be inaccurate or incomplete, and they are not statements, promises or advice from TRGS. Do not rely on them to make decisions; a person at TRGS confirms anything that matters.
- It is recorded. Conversations are kept and read by our team, as our Privacy Policy explains.
- Share only what is needed. Do not send payment card numbers, passwords, health information, trade secrets, or other people's personal information without their permission. Send confidential material only after an NDA is in place.
- It can say no. The agent may decline requests, hand you to a person, or stop. We may limit, change or withdraw any tool at any time.
4. Acceptable use
Use the site lawfully and in good faith. You must not, and must not help anyone else to:
- break any law, or infringe anyone's rights, including privacy and intellectual property rights;
- harass, threaten, defame or deceive anyone, or pretend to be someone else or to speak for TRGS;
- send spam or unsolicited messages, including through the site's forms, the agent or the emails they trigger;
- try to make the agent ignore its instructions, reveal its instructions or internal information, produce harmful, misleading or unlawful content, or act outside its purpose (including "prompt injection" and "jailbreak" attempts);
- query the agent or the forms automatically or in bulk, or use them to build or improve another product;
- scrape, crawl, harvest or copy the site or its content, other than through ordinary search engine indexing that follows our
robots.txt, or use it to train or evaluate AI models without our written permission; - probe, scan or test the site's security, or get around its security, rate limits, consent choices or other controls, except as allowed in section 11;
- upload or transmit malware, or interfere with or overload the site or the systems behind it (including denial-of-service attacks);
- copy, modify, reverse engineer or decompile the site's code, except as the law expressly allows;
- frame or mirror the site, or present it or its content as your own;
- collect other people's personal information from the site.
5. Our content and marks
The site and its content, including its text, design, graphics, animations, code and data, belong to TRGS or its licensors and are protected by copyright, trademark and other laws. TRGS, the TRGS compass, Publiso, ARSC, Stradi Suite, the names of our agents, and our other names and logos are our marks. You may not use them without our written permission, except to refer to us accurately.
We give you a limited, personal, revocable, non-transferable licence to view the site and to print or save a reasonable number of pages for your own use or to evaluate working with us. All other rights are reserved.
6. What you send us
You own what you send us. You confirm that you have the right to send it and that it does not break any law or anyone's rights. You let us use it to respond to you, to evaluate and discuss working together, to operate, secure and improve the site and the agent, and as our Privacy Policy describes.
Until a confidentiality agreement is signed, what you send is not treated as confidential beyond our Privacy Policy. We work on many ideas and may already be developing, or later develop independently, something similar to what you describe; nothing in these terms stops us from doing so. If you send suggestions or feedback about the site or our products, we may use them freely and without any obligation to you.
7. Third-party software, services and links
The site uses third-party software and services, including open-source software, fonts licensed under the SIL Open Font License, and Google Analytics. Each is provided under its own licence and terms, which remain in force and are not changed by these terms. The site also links to other sites, such as publiso.io and our social media pages. We do not control third-party sites or services and are not responsible for their content, availability, security or privacy practices; using them is at your own risk and under their terms.
8. Technology materials
We may make technical or business materials available through the site or directly: presentations, documents, specifications, diagrams, demos, prototypes, code, sample data and the like. Unless a written agreement says otherwise, they are provided for your evaluation only, remain ours (or our licensors'), and may not be redistributed, sold, published or used to build competing products. They are provided as is, may contain errors, and are not a commitment that any feature, design or result will be delivered. You are responsible for following the laws that apply to your use of them, including export laws.
9. Products and early access
Our products (Publiso, ARSC and Stradi Suite) are governed by their own terms when you use them. Descriptions, features, prices and launch dates may change. Joining a waitlist or asking for early access does not guarantee access, a launch date or particular terms.
10. Dealing with us, online and in person
- Communications. Email and online messages are not perfectly secure, and a message is not received until we confirm it. We send marketing emails only with your consent, as Canada's anti-spam legislation requires, and each lets you unsubscribe.
- Meetings, calls and demos. Information shared in meetings, calls, demos and proposals is general and not binding until it is set out in a signed agreement. Please do not record a meeting without everyone's consent.
- Visits and physical items. When you visit our premises or a project site, or we visit yours, everyone follows the host's reasonable safety, security and site rules. Devices, hardware and samples we show or lend remain ours and must be returned on request. Hardware sourced or installed for a project is covered by that project's agreement and by the manufacturers' warranties; nothing is sold through the site.
- Respect. We expect respectful conduct from everyone dealing with us, as we expect it of ourselves, and may end an interaction that becomes abusive.
11. Reporting security issues
If you find a security vulnerability, tell us at info@trgs.group with the subject "Security report". Act in good faith: do no more testing than needed to show the issue, do not access, change or keep other people's data, do not disrupt the site, and give us reasonable time to fix it before telling anyone else. We will not pursue good-faith reports that follow these rules.
12. Disclaimers
To the extent the law allows, the site, the agent and all content and materials are provided "as is" and "as available", without warranties or conditions of any kind, express or implied, including merchantability, quality, fitness for a particular purpose, accuracy, availability and non-infringement.
Nothing in these terms excludes or limits any right you have under consumer protection law that cannot be excluded or limited.
13. Limitation of liability
To the extent the law allows, TRGS and its directors, officers, employees, contractors and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, arising from or relating to the site, the agent, any content or materials, or these terms, however caused and even if we were told they were possible. Our total liability for any claim relating to the site is limited to one hundred Canadian dollars (CAD $100).
These limits do not apply to liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence where the law does not allow it to be limited. Liability under a signed agreement with us is governed by that agreement.
14. Indemnity
To the extent the law allows, you will defend, indemnify and hold harmless TRGS and its directors, officers, employees, contractors and agents from claims, losses, damages and costs (including reasonable legal fees) arising from your breach of these terms, your misuse of the site, or what you send us.
15. Suspension and enforcement
We may limit, suspend or block anyone's access to the site, the agent or any tool, without notice, if we reasonably believe these terms are being broken or the site, our users or TRGS are at risk. We may keep records of misuse, report it to the authorities, and take legal action, including seeking an injunction, and we may recover our reasonable costs where the law allows. Sections 5 to 8 and 12 to 17 continue to apply after you stop using the site.
16. Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. You and TRGS agree to the exclusive jurisdiction of the courts of British Columbia, sitting in Vancouver, except where the consumer protection law of your province or country gives you the right to bring a claim where you live.
17. General
- Changes. We may update these terms. The date at the top shows the latest version, and using the site after a change means you accept it.
- Whole agreement. These terms and our Privacy Policy are the whole agreement between you and TRGS about using the site. A signed agreement with TRGS governs the work it covers.
- Severability and waiver. If any part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it.
- Assignment. You may not transfer your rights under these terms. We may transfer ours, for example to a successor business.
- Language. These terms are written in English. Where we offer a translation, the English version governs to the extent the law allows.
